WELL AI - CALORIE TRACKER TERMS AND CONDITIONS

1.1 Binding Agreement

These Terms constitute a legally binding agreement between Vansh Shah, operating under the trade name "Well AI" ("we," "us," or "our") and you ("User" or "you"). By downloading, installing, or using the App, you confirm your acceptance of these Terms, our Privacy Policy, and Apple's App Store Terms of Service.

1.2 Updates to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance. Material changes will be communicated via email or in-App notifications.

2.1 Age Requirement

You must be at least 13 years old to use the App. Users under 18 ("Minor Users") must obtain parental/guardian consent to use the App.

2.2 Geographic Restrictions

The App is intended for use in India. You are responsible for compliance with local laws.

3.1 Account Creation

To access features like food history tracking, you must register an account by providing accurate information (e.g., age, weight, health goals).

3.2 Account Security

• RevenueCat facilitates subscription management but does not handle payment data.

4.2 Subscription Terms

• Subscriptions auto-renew unless canceled at least 24 hours before the current period ends.
• Manage subscriptions via your Apple ID settings. We do not process refunds or cancellations directly.

4.3 Free Trials

Free trials (if offered) automatically convert to paid subscriptions unless canceled before the trial ends.

4.4 Refunds

Refunds are subject to Apple's policies. We do not guarantee refunds unless required by Indian law.

5.1 Prohibited Conduct

You agree not to:

• Reverse-engineer, decompile, or create derivative works of the App.
• Upload harmful content (e.g., viruses, malware).
• Use the App for illegal purposes (e.g., harassment, fraud).

5.2 Content Ownership

You retain ownership of content you upload (e.g., food photos) but grant us a non-exclusive, worldwide license to use it for App functionality.

5.3 Health Disclaimer

• Nutritional data (e.g., calories, macros) is for informational purposes only.
• Consult a healthcare professional before making dietary or medical decisions.

6.1 Ownership

The App, including its design, code, logos, and content, is the exclusive property of Vansh Shah or its licensors (e.g., Google Vision API, USDA database providers).

6.2 Licenses

• You are granted a limited, non-transferable license to use the App for personal, non-commercial purposes.
• You may not copy, modify, or distribute App content without prior written consent.

7.1 Integration Disclaimer

The App relies on third-party services, including:

• Google Vision API for food recognition.
• USDA Food Database for nutritional data.
• Firebase for backend infrastructure.

We are not responsible for inaccuracies, outages, or changes to these services.

7.2 Third-Party Links

The App may contain links to third-party websites. We do not endorse or control these sites.

8.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted, error-free, or virus-free operation.

8.2 Nutritional Data Accuracy

• Nutritional information is sourced from third-party databases and may contain errors.
• Portion size estimates are approximations.

9.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• LOSS OF DATA, REVENUE, OR PROFITS ARISING FROM APP USE.

9.2 Cap on Liability

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE LAST 12 MONTHS.

10.1 By Us

We may terminate your access to the App for violations of these Terms, fraud, or unlawful activity.

10.2 By You

You may stop using the App at any time by deleting it from your device.

10.3 Effect of Termination

Upon termination, your subscription (if active) will not be refunded.

11.1 Governing Law

These Terms are governed by the laws of India, including the Information Technology Act, 2000, and the Consumer Protection Act, 2019.

11.2 Dispute Resolution

Any disputes shall be resolved through binding arbitration in Ahmedabad, Gujarat, under the Arbitration and Conciliation Act, 1996.
